Welcome to FineGrain Scan Lab. By using our services, you agree to the following terms:
1. Our Services
Fine GrainScan Lab provides professional digitization services for developed photographic prints, negatives, and slides.
Important: We do not develop undeveloped film. We only scan film that has already been professionally processed.
2. Prohibited Content
We reserve the right to refuse service for any material that violates the following:
We do not digitize nudes, explicit, adult, or sexually suggestive content.
We do not digitize private, intimate, or erotic photographs or related materials.
We do not accept illegal, copyrighted material you do not own the rights to, hateful, defamatory, or abusive content.
Any content that appears to involve minors in an inappropriate context will be immediately reported to the proper authorities.
If we discover prohibited content after receiving materials, we reserve the right to refuse scanning, destroy the materials, and cancel the project without refund.
3. Payments
We accept all major credit cards, including Visa, Mastercard, American Express, and Discover.
After we send you a quote via email, we will send a secure payment link with the full invoice amount.
A 25% non-refundable deposit is usually required to begin work on your project.
The remaining balance is due after the digitization is complete and before we return your original materials.
Once scanning is finished, we will first send you the digitized files for review. You will have the opportunity to request adjustments.
Final payment of the remaining balance is required once both parties agree that the job is satisfactory.
Your original physical materials will not be returned until the final balance is paid in full.
Shipping Charges (Return of Materials):
The client is responsible for all shipping charges related to the return of their original materials.
We ship returns via FedEx, UPS, or USPS.
We will obtain a quote for shipping + adequate insurance and add it to the final invoice.
The client must approve and pay for return shipping before we ship the originals back.
4. Client Materials & Shipping
You are fully responsible for safely packaging and shipping your original materials to us.
We strongly recommend that you purchase shipping insurance through the carrier you choose (FedEx, UPS, USPS, etc.) for the full replacement value of your materials.
Fine Grain Scan Lab is not responsible for any loss, damage, or destruction of your materials while in transit to or from our facility.
Once your materials arrive at our lab, we will handle them with reasonable care.
5. Turnaround Time
Turnaround times are estimates only and are not guaranteed.
Delays may occur due to high volume, technical issues, or the condition of the materials.
6. Digital Files & Ownership
Upon completion and final payment, we will deliver the high-resolution digital files.
You retain ownership of your original physical materials.
We do not retain the right to use sample images from your collection for marketing and portfolio purposes.
7. Refunds & Cancellations
All deposits (25% or otherwise) are non-refundable once paid, as they cover initial assessment, scheduling, and preparation of your project.
Once scanning work has begun on any portion of your materials, the entire job becomes non-refundable.
Cancellations are only accepted in writing before any scanning begins. A cancellation fee may still apply.
No refunds will be issued for completed work, even if you are dissatisfied with the final product after review.
In the event we must refuse service due to prohibited content or other violations of these terms, no refund will be provided.
8. Liability
To the maximum extent permitted by law, FineGrain Scan Lab’s total liability under any claim shall be strictly limited to the total amount actually paid by the client for the specific services rendered.
We are not liable for:
Any loss, damage, or destruction of original materials during shipping (to or from our lab).
Any pre-existing damage, fading, scratches, or deterioration of your originals.
Any sentimental, emotional, or intrinsic value of your materials.
Consequential damages, lost profits, loss of use, or any indirect, incidental, or punitive damages.
Any issues resulting from the quality, condition, or age of the original materials provided by the client.
Any damage that occurs despite our reasonable care.
By using our services, you agree to waive any claims beyond the amount paid for our services. You assume all risk related to the sentimental or monetary value of your materials.
9. Force Majeure
FineGrain Scan Lab shall not be liable or responsible for any delay or failure to perform its obligations under this agreement if such delay or failure is caused by events beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemics, epidemics, government orders or restrictions, strikes, labor disputes, power outages, internet or utility failures, severe weather, or any other force majeure event. In such cases, we will make reasonable efforts to notify the client and resume services as soon as possible.
10. Privacy
We respect your privacy. Your personal information and images are kept confidential and are not sold to third parties.
11. Governing Law
These Terms are governed by the laws of the State of Nevada, United States.
